Following is my response attached to the ARB Notice of Public Hearing form: Feel free to copy it, or cut and paste it onto a page and attach it to your form. Be sure to sign it, with your property identified, and be sure to staple it with the form and return it, noting on the back of the original form to "see attached page of objections". Feel free to personalize it with your own objections--nothing is cast in stone here...let them know how you feel. It is recommended to send it by mail with a return receipt requested. You can also take it in person to Tiffany at the main desk of the Taltrust office. She is capable and efficient and will make sure the ARB receives it. While I am there, I will look again at the actual application that contains all the sham documentation...I recommend that everyone look up their own homes and the properties of a few friends....you will be shocked (!) how little information they are using to tie up your home forever with permanent deed restrictions. Subject: Lafayette Park Neighborhood Nomination to the Tallahassee-Leon County Register of Historic Places - Order of Recommendation I/WE, as owner(s) of Lot(s)____________________, Block___________, of the _____________________(NAME OF SUBDIVISION) or ___________________________(Street Address) wish the following facts to be considered by the Architectural Review Board: BE ADVISED: I object to the classification of my property in Lafayette Park as either a "CONTRIBUTING or NON-CONTRIBUTING PROPERTY" for purposes of placement in a Historical Preservation Overlay and/or District. There is no stated substantive basis for the classification of my property nor is there any evidence or proof that the persons involved in the surveys and classifications were qualified to perform these duties and make these determinations. There is also no evidence that the work product was ever reviewed and approved by a qualified reviewing authority. I demand the opportunity to challenge this classification in a Quasi-Judicial Hearing before the Architectural Review Board and/or before the Tallahassee-Leon County Planning Commission. I also respectfully request that I be afforded the opportunity to question the Historical Preservation Officer and all of his current and/or past employees that were involved in the surveys of the affected properties and who may have had any direct or indirect input into these classifications. We would respectfully request that all testimony before the Quasi-Judicial Panel be in a formal evidentiary forum which will permit cross examination of each witness. Furthermore, I object to the limited, partial public hearing review of an application which has NEVER been brought to the public through proper Notice. The presumption by the Architectural Review Board to pretend that an application that is similar to one which was withdrawn on August 8, 2008 can continue in the stead of that one, with entirely different applicants is a violation of my civil right of due process, and harms our entire community in addition to harming me specifically and immeasurably and deliberately. And in addition, the application under review is knowingly flawed by virtue of it's use of a substitute, non-official OWNER AWARENESS FORM, which seeks to legitimize the exclusion of the participation of all but two of the property owners in a 475+/- property neighborhood, in further violation of my civil rights, and in violation of the Tallahassee Land Development Code and Florida Statutes.
